The U.S. Department of Agriculture will no longer distribute free turkey and ham to schoolchildren, which critics say is an unconstitutional display of government authority.
The D.C. Superior Court in Washington, D.C., ruled Thursday that the USDA cannot “distribute food in the schools that is not affordable to students due to their income level, including free food,” said the U.S. Fish and Wildlife Service.
Officials in Montgomery County, Maryland, sued in July 2012 after the agency cut the free turkey from its lunch line for the county’s fifth graders.
“I really am disappointed the USDA has no intention of increasing funding for schools,” Superintendent Pat Gorman said in a statement. “But in the face of increased cost pressure, it is imperative that schools continue to focus on nutrition and nutrition education, especially in the most impoverished communities.”
In a court filing in September 2013, the county’s legal experts claimed the USDA’s requirement is unconstitutional.
“Congress has repeatedly recognized the need to fund schools with sufficient amounts of school funding,” the filing said.
The U.S. Constitution’s 2nd and 4th Amendments prohibit the government from taking “unjust discrimination” nor “substantially burdensome regulation or control of trade or commerce.”
While federal officials are under a lawsuit, several states — including Virginia, Colorado and Iowa — have enacted laws granting the USDA special authority to subsidize free food at school.
