The Canadian-based company, which makes the popular Kinko’s gum and other snack foods, has become the target of a $10-million lawsuit in New York and California accusing it of “disrespecting” Muslims and “inciting hatred” with a new ad campaign that depicts two Muslims praying in a mosque with their mouths covered.

The lawsuit filed against the company’s parent company, Mondelez International, states the company is promoting “a deliberate and deliberate misrepresentation” of “the religious beliefs of Muslim Americans” and “violating their religious and civil rights by encouraging the public to believe that Muslims worship in secret, and by disparaging them in a way that seeks to incite religious hostility toward them and thereby create hostility and further division.”

On Tuesday, the lawsuit stated that a new ad campaign launched last month by the company is in direct violation of the First Amendment.

It alleges the ads feature Muslim families at home praying under cover of darkness with their mouths unclenched, which is contrary to Islam, which prohibits the wearing of face masks in public.

It is not the first time the company has been accused of promoting Muslims’ “secret” religious beliefs. The same ad campaign was launched in 2009 which featured Muslim women praying while being covered “with a veil.”

‘I believe they shouldn’t be in a hijab,’ says Canadian imam

After the ad aired in 2009, Muslim families who attended the event were threatened with being fired by the company. In response, the company said it would “remove the ad and issue an apology to those families and their children.”

Sammie Abou El-Hadi, a Muslim who attended the 2009 event, says she feels a similar way today. She said the family she spoke with was promised a full refund with an apology in the mail
